2. General information

We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. You can visit this website without providing any information about yourself. Personal data is processed only to the extent described in the following sections.

This website does not use any analytics, tracking, or advertising services. The only external service is the appointment booking widget from Cal.com, which is loaded only after you have given your consent (see Section 6).

Data transmitted between your browser and this website is encrypted via TLS (recognizable by the lock icon and by "https://" in the address bar).

We do not share your data with third parties unless this is necessary for the performance of a contract, you have given your consent, we are legally obligated to do so, or the data is shared with processors bound by our instructions (such as our hosting provider) with whom data processing agreements pursuant to Art. 28 GDPR are in place. You are neither legally nor contractually required to provide personal data; without it, the only consequence may be that certain features (such as appointment booking) are not available to you.

3. Hosting and server log files

This website is hosted by Vercel. The provider is Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA ("Vercel"). Server-side processing (such as delivering dynamic pages) takes place in a data center in Frankfurt am Main, Germany; static content is additionally delivered via Vercel's globally distributed content delivery network (edge network). When you access the website, Vercel automatically collects information in so-called server log files, which your browser transmits:

This data is not combined with other data sources and is used solely for the technical provision, stability, and security of the website (for example, to defend against attacks). The legal basis is our legitimate interest in providing the website securely and reliably (Art. 6(1)(f) GDPR). The log files are automatically deleted after a short period.

A data processing agreement pursuant to Art. 28 GDPR is in place with Vercel, obligating Vercel to process our website visitors' data only in accordance with our instructions and in compliance with the GDPR. Even though server-side processing takes place in Frankfurt, Vercel as the provider is based in the USA, so access from the USA or a transfer there cannot be ruled out. Such a transfer is based on the standard contractual clauses of the EU Commission (Art. 46 GDPR), which form part of Vercel's data processing agreement. Further information can be found in Vercel's privacy policy: https://vercel.com/legal/privacy-policy.

4. Cookies, consent, and local storage

This website does not set any cookies for tracking, statistical, or advertising purposes.

On your first visit, we ask via a notice (consent banner) whether external services may be loaded. We store your decision exclusively locally in your browser (localStorage, entry "fairoo-consent" containing your selection, its version, and the time of your decision). No data is transmitted to us or to third parties in the process. This storage is strictly necessary for the operation of the website (Section 25(2) no. 2 TDDDG); at the same time, it serves as proof of your consent (Art. 7(1) GDPR) and thus our legitimate interest (Art. 6(1)(f) GDPR). The entry remains stored until you delete it via your browser settings or change your selection.

External services (currently only appointment booking via Cal.com, Section 6) are loaded only after you have given your consent. You can revoke or adjust your consent at any time with effect for the future: via the "Cookie settings" link in the footer of every page, or directly here:

5. Contact by email or phone

If you contact us by email or phone, we process the data you provide (name, contact details, content of your inquiry) in order to handle and respond to your inquiry. On the "Pricing" page, you can also generate a pre-filled email using your own email client; here too, data is transmitted only once you send the email yourself.

The legal basis is Art. 6(1)(b) GDPR if your inquiry relates to the initiation or performance of a contract, and otherwise our legitimate interest in responding to inquiries (Art. 6(1)(f) GDPR). We store the data until your matter has been fully resolved, and beyond that only to the extent required by statutory retention obligations (for example, for business correspondence under Section 257 HGB and Section 147 AO).

6. Appointment booking via Cal.com

For online appointment booking (demo appointments), we embed the booking widget of the service Cal.com. The provider is Cal.com, Inc., 2261 Market Street #4382, San Francisco, CA 94114, USA.

The widget is loaded only after you have given your consent, either via the consent banner (category "External services") or via the "Activate Cal.com" button directly in the booking area. Before that, no connection to Cal.com's servers is established. As soon as the widget is loaded, your browser establishes a connection to Cal.com; for technical reasons, this transmits, among other things, your IP address, browser and device information, and the date and time of the request, and Cal.com may use cookies or comparable technologies in your browser. If you book an appointment, Cal.com additionally processes the data you enter, typically your name, email address, the selected appointment, and optional details about your request.

The legal basis for loading the widget is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). The legal basis for processing the booking data to arrange and conduct the appointment is Art. 6(1)(b) GDPR. You can revoke your consent at any time with effect for the future via the cookie settings (see Section 4).

Cal.com is based in the USA; a transfer of personal data to the USA can therefore not be ruled out. The transfer is based on the standard contractual clauses of the EU Commission (Art. 46 GDPR), which are part of Cal.com's data processing agreement, as well as on your consent. Further information can be found in Cal.com's privacy policy: https://cal.com/privacy.

7. Fonts (locally hosted)

This website uses the Roboto Mono font. The font files are stored locally on our server and are delivered from there. No connection to servers of Google or other font providers is established when you visit this website.

8. Storage period

Unless a more specific storage period is stated in this privacy policy, personal data remains with us until the purpose of the processing no longer applies, you revoke your consent, or you submit a legitimate request for deletion. Where statutory retention obligations exist, the data is deleted once those obligations expire.

9. Your rights as a data subject

With regard to your personal data processed by us, you have the following rights:

Right to object (Art. 21 GDPR): Where we process data on the basis of our legitimate interest (Art. 6(1)(f) GDPR), you have the right to object to the processing at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.

To exercise your rights, an informal message to hannes.wagner@fairoo.de is sufficient.

You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), in particular in the member state of your habitual residence, your place of work, or the place of the alleged infringement. The supervisory authority responsible for us is the Bayerisches Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach, www.lda.bayern.de.

10. No automated decision-making

No automated decision-making, including profiling (Art. 22 GDPR), takes place on this website.

11. Changes to this privacy policy

We will update this privacy policy whenever data processing on this website changes, for example due to new features or services. The version published here applies in each case.
